The following rules and regulations shall be binding upon the unit owners, lessees and all renters. Unit owners have signed an agreement to abide by the By-Laws and Declaration. The Rules and Regulations are included in those documents. Unit owners who lease or rent their units shall include in the lease/rental agreement that the lessee/renter agrees to be bound by the rules and regulations. Unit owners shall provide a copy of these rules and regulations to all lessees/renters and inform them they must agree to abide by them.
Unit owners who violate any rule or regulation shall, upon request, appear before the Board of Directors. Lessees who violate any rule or regulation are subject to revocation of their lease by the unit owner and, upon request; the unit owner shall appear before the Board of Directors. Renters who violate any rule or regulation shall cause the unit owner, upon request, to appear before the Board of Directors. Unit owners who violate or allow renters/lessees to violate any of these Rules and Regulations may be subject to a fine, to be determined by the Board of Directors.
- Unit owners shall inform the Manager if their unit is available to be rented at any time, for any length of time. Unit owners shall inform the Manager of dates when their unit is available to rent.
- Unit owners shall inform the Manager of the name(s) of any and all lessees or seasonal renters, and the specific dates of the lease or rental. The maximum capacity of lessees/renters in any single unit shall be six (6).
- Unit owners are discouraged from listing their units on websites such as Airbnb, which generate a specific, short-term type of client, creating excessive turnover. The minimum rental is one month, unless the unit is grandfathered by law.
- Unit owners shall inform all renters and/or overnight guests to report to the Manager’s office to obtain a parking permit, to be displayed at all times in the vehicle. (Office hours are 8-noon weekdays.) At that time, the renters must sign a form confirming they have been given a copy of the Rules & Regulations, have read them, and agree to abide by them. If they have not been provided with a copy by the unit owner, the Manager will give them a copy of the Rules and Regulations, and the unit owner will be assessed a $20 convenience fee.
- Disturbances or annoyances that disrupt the tranquility of other residents shall not be allowed, especially after ten (10) P.M. Unit owners have the right of peaceful possession of their units, free from unwarranted nuisances.
- Walkways and passageways set aside for pedestrian travel on the first and second levels shall be kept passable. Vinyl/plastic stackable chairs or folding lawn chairs are permitted so long as they do not cause the walkways and passageways to be impassable. The Manager shall warn unit owners, lessees and seasonal renters of violations. If the violation continues, the item or items will be confiscated and removed to the utility shed area and will be disposed of if not claimed within 30 days.
- No items shall be hung from walkway or passageway railings or windows. Flowers, flower pots, plants, or decorative items shall not be allowed in the common area without permission of the Board of Directors. Holiday decorations are permissible in the appropriate holiday season. Holiday decorations may be placed up ten (10) days before the holiday and must be taken down five (5) after the holiday, except that holiday decorations will also be permitted commencing the first Monday after Thanksgiving through the first Monday after January 1st. Management may require the removal of any decoration which creates a safety hazard, or in the discretion of the Board creates an eyesore. Unit owners may not cause damage to the Condominium Property in connection with the installation of decorations.
- Lanais shall not be used for storage or in any other manner that would create an unsightly condition, as determined by the Board of Directors.
- No antennas, equipment of any type, or signage of any type shall be affixed anywhere outside a unit.
- Recreation vehicles, trailers, campers, boats, kayaks or similar equipment shall be parked in a space that would not obstruct other vehicles, and in any case, for no longer than 48 hours unless approved by the Manager. None of the above stated equipment may be stored in common areas or alongside buildings
- Disposal of garbage and trash: Garbage shall be in plastic bags securely tied. Carton and cardboard boxes shall be compacted and placed in the blue recycle containers. The four dumpsters at the four corners of the property are to be used for all non-recycled waste, and if one is full, use one of the others. The County Health Department requires closed lids on garbage containers.
- Charcoal or flammable fuel grills shall not be used in lanais or within fifteen (15) feet of the buildings. Grills, beach towels, swimming or boating equipment and toys shall not be left on the common elements.
- No smoking or vaping shall be permitted within fifteen (15) feet of the buildings.
- Riding any type vehicle on the grass areas, tennis/pickleball courts or pool deck is prohibited. Maintenance vehicles are the exception.
- Tennis shoes or appropriate soft-soled shoes shall be worn on the tennis/pickleball courts. The courts shall not be used for any purpose other than tennis, pickleball or shuffleboard, except with the permission of the management. Management reserves the right to deny the use of the courts at any time.
- A vehicle, which is not currently licensed or cannot operate under its own power, shall not remain on the condominium property for more than forty-eight (48) hours. The term licensed under this rule shall mean that the vehicle displays, at all times, a valid license plate or other license tag to which is affixed a sticker indicating that the vehicle is currently registered.
- The Manager or the duly elected officer who has reasonable cause that the vehicle is unable to operate under its own power shall notify the registered owner of the vehicle that such owner is in violation of the condominium rules and regulations. The owner of the vehicle shall have twenty-four (24) hours to respond to the Manager and demonstrate that the vehicle can operate under its own power. If the owner cannot so demonstrate, or if the owner does not contact the Manager, the vehicle will be towed away at the owner’s expense.
- The owners of vehicles who desire to have their vehicles in a parking space during their absence over the summer, or any time they are away for an extended period, shall obtain permission from the Manager and leave a key on file in the office.
- Any unit owner with two (2) vehicles may park one of them in their numbered, designated space. The second vehicle must be parked in one of the guest spots between buildings. Further, if an owner rents or leases their unit and leaves a vehicle here, the renter is entitled to the designated parking space. The owner’s vehicle shall be parked in a guest spot between buildings.
- Vehicles shall be parked only in designated, numbered spaces or guest spaces, so as not to obstruct through traffic.
- All owners’ vehicles shall display a permanent sticker to designate it is permitted on the property.
- There shall be no vehicle washing permitted on Davis Lake property. Wiping down vehicles is permissible.
- Fishing or use of any watercraft is prohibited in the lake.
- Unit owners shall be responsible for damage to common areas caused by themselves or their lessees, seasonal renters, guests, family members or other visitors. Costs for damages shall be billed directly to the unit owner.
- Pets shall not be permitted in or near any unit or on the condominium property, as ratified by the unit owners on March 18, 1989.
- Motorcycles or trucks in excess of one-half (1/2) tons shall not occupy parking spaces on the condominium property.
- Bicycles shall be parked in bicycle racks at all times. Bicycles shall not be parked on walkways or passageways set aside for pedestrian travel. Unit owners, lessees and seasonal renters shall identify their bicycles by affixing an identification tag showing their condo unit number and bicycle owner’s name. The tag shall be located at the rear of the bicycle.
- Bicycles that are not identified by a tag shall be removed to the utility shed area and if not claimed within thirty (30) days shall be disposed of.
- Bicycles shall be stored inside the owner’s unit when the unit is unoccupied.
- No plantings of any kind shall be permitted without the approval of the gardening committee and the Board of Directors.
- Hard surface flooring, such as ceramic tile, in a second-floor unit must have sound proof sub surface material installed. The minimum sound proofing material shall be of such kind and quality to achieve STC and IIC ratings of at least 47 in bathrooms and 52 in all other area and as the Board may further specify.
- Swimming pool and deck area:
- The pool will be open from 8:00 A.M. to dusk weather permitting. Absolutely NO swimming is permitted after dusk. Violators will be given a warning. Further violation will result in suspended use of the pool.
- Only unit owners, lessees, seasonal renters and guests shall use pool.
- Swimmers shall shower before using the pool.
- Deck furniture shall not be removed from the deck. All deck furniture and umbrellas shall be returned to their original position after use.
- Running, jumping or roughhousing shall not be allowed.
- No smoking or vaping shall be permitted in the pool area.
- No rafts shall be used without permission of the Manager.
- Food, drinks, glass bottles, dishes or any glass or ceramic pieces are prohibited in the pool or on the pool deck.
- Children who are not toilet trained or adults who are incontinent shall wear waterproof pull-up pants.
- For their own safety, children under twelve (12) years of age must be accompanied by a responsible adult.
- Management reserves the right to deny the use of the pool at any time.
